Drafting a Parenting Plan through a process of assistance

Not all matters can be mediated. Mediation requires two parents who are capable of contained discussion and are willing to attempt constructive problem solving with the assistance of a mediator/s.

There are various mediation models. In South Africa, facilitative mediation is the most widely used approach.

In matters where concerns are raised about violence, impairment, relationship difficulties between parents and chidlren, alienation, substance dependency or abuse a process of assistance might be more appropriate than a process of mediation. Assistance is not defined in the Act but is broadly understood that a process of investigation or assessment is required before a Parenting Plan is recommended by the practitioner.
